These Terms of Service (“Terms”) govern your use of lucabay.com (the “Site”) and any purchase you make from Luca Bay LLC, a Wyoming limited liability company (“Luca Bay,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. The Site and our products are offered to customers in the United States only.
2. Products and descriptions
We try to describe and display our products accurately, including dimensions, materials and vehicle compatibility. Colors may vary slightly by screen, and universal-fit products may need trimming or adjustment. Please check measurements against your vehicle before ordering. We do not warrant that product descriptions or other content on the Site are error-free.
3. Pricing and payment
All prices are in U.S. dollars. Prices and availability may change without notice. If a product is listed at an incorrect price because of an error, we may cancel the order and refund any amount charged. Payments are processed by our third-party payment providers; we do not store full card numbers. You confirm that you are authorized to use the payment method you provide.
4. Orders
Your order is an offer to buy. We may accept, decline or cancel any order, including for suspected fraud, stock limits or pricing errors. If we cancel an order after you have been charged, we will issue a full refund.
5. Shipping
Shipping is governed by our Shipping Policy. Risk of loss passes to you when your order is delivered.
6. Returns and refunds
Returns and refunds are governed by our Refund and Returns Policy.
7. Product use and safety
Install and use our products according to the included instructions. Car accessories must never obstruct the driver’s view, pedals, airbags, seat belts or other vehicle safety systems. We are not responsible for damage or injury resulting from improper installation, misuse or modification of a product.
8. Intellectual property
All content on the Site, including text, images, logos and the Luca Bay name, is owned by or licensed to Luca Bay and protected by intellectual property laws. You may not copy, reproduce or use it for commercial purposes without our written permission.
9. Reviews and submissions
If you post a review or send us feedback, you grant us a non-exclusive, royalty-free right to use, reproduce and display it in connection with our business. Reviews must be honest and must not contain unlawful, offensive or misleading content. We may remove any submission at our discretion.
10. Prohibited uses
You agree not to use the Site for any unlawful purpose, interfere with its security or operation, scrape or harvest data from it, or impersonate any person.
11. Disclaimer of warranties
Except as expressly stated on the Site or required by law, the Site and our products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Luca Bay will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some states do not allow these limitations, so they may not apply to you.
13. Indemnification
You agree to indemnify and hold Luca Bay harmless from any claims arising out of your violation of these Terms or your misuse of the Site or our products.
14. Privacy
Your use of the Site is also subject to our Privacy Policy.
15. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, except where the consumer protection laws of your state of residence apply.

We may update these Terms from time to time. The “Last updated” date above shows when they were last changed. Continued use of the Site after changes means you accept the updated Terms.
